1. Acceptance of Terms
By accessing or using Brand HQ ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Service.
2. Description of Service
Brand HQ provides a digital asset management and brand activation platform that enables users to upload, manage, organize, and share brand assets and related content.
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into this agreement.
4. User Responsibilities
You agree not to use the Service to upload, store, share, or distribute any of the following:
• Illegal content of any kind
• Images or depictions of weapons, drugs, or drug paraphernalia
• Pornographic, sexually explicit, or obscene material
• Content that infringes on intellectual property rights
• Malicious code, malware, or harmful software
• Content that is defamatory, harassing, or abusive
Brand HQ reserves the right to remove or restrict access to any content that violates these rules.
5. Accounts
You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account will be deemed your responsibility.
6. Payment and Subscriptions
• Access to certain features of Brand HQ requires a paid subscription.
• Fees are billed on a recurring basis (monthly or yearly) depending on the plan you choose.
• Payments are processed securely through Stripe. By providing payment information, you authorize us (and Stripe) to process recurring payments for your subscription.
Refunds & Cancellations:
• Monthly plans: Non-refundable once billed. You may cancel anytime, and access remains until the end of the billing cycle.
• Annual plans: Non-refundable once billed. You may cancel anytime, and access remains until the end of the paid annual term.
• No partial or prorated refunds.
• Refunds, credits, or adjustments may be issued at our sole discretion (e.g., billing errors or duplicate charges).
7. Intellectual Property
All rights, title, and interest in and to the Service (excluding user-uploaded content) are owned by Hire Scout Inc. (DBA Brand HQ). Users retain ownership of the content they upload, but grant Brand HQ a limited license to store, process, and display such content for the purpose of providing the Service.
8. Termination
We reserve the right to suspend or terminate your account at any time, without notice, if you violate these Terms.
9. Disclaimer of Warranties
Brand HQ is provided on an “as-is” and “as-available” basis. Hire Scout Inc. makes no warranties, whether express, implied, statutory, or otherwise, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, error-free, secure, or free of harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, Hire Scout Inc. and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of Brand HQ. Our total liability for any claim relating to the service shall not exceed the amount you paid, if any, to use Brand HQ in the six months prior to the event giving rise to the claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada.
12. Changes to Terms
We may update these Terms at any time. Users will be notified of significant changes via email or in-app notification. Continued use of the Service constitutes acceptance of updated Terms.
